Supreme Court Chaos

 



With the election lose looming over the democrats heads, they have decided to pursue one more piece of progress before Biden leaves The White House. There have been grumblings of 70 year old Sonya Sotomayor leaving her position on the Supreme Court bench, so they can replace her with a younger democrat. Justice Sotomayor says she is not willing to step down, however, leaving panic within the democratic coalition. Technically it is not right to bully a Scotus judge off the bench for partisan politics, but it is being tried. They are comparing the potential seat swap to Trump's appointment of Amy Coney Barret, but she was replaced because of an actual vacancy. It can be argued that the process was rushed and possibly not right, but not comparable to the current scenario with no vacancy. Forcing out Sotomayor, assuming she would agree to go, could be politically risky, and a successful confirmation before Trump's inauguration on Jan. 20, 2025, logistically impossible. Those realities have seemed to be sinking in among some key Democratic players. (ABC). It is unclear if they would even have the support to pass the measure. Joe Manchin would likely not support and a few days ago Bernie Sanders said he was against the idea of a swap. “No,” Sanders said, when asked by “Meet the Press” moderator Kristen Welker whether he thinks Sotomayor, who is 70, should step down from her post while Biden can nominate a liberal replacement. (NBC). So, it is unlikely, but not impossible. It would be an immense disaster if following a pretty bad election loss, the democrats tried to get a judge replacement and failed. The idea is even being floated around that Kamala Harris would be the replacement. A liberal pundit Sunday floated nominating failed presidential candidate Kamala Harris to replace US Supreme Court Justice Sonia Sotomayor while the Democrats still cling to power. (NY Post). This is all just talk, but it is interesting to see a liberal appointed supreme court justice be treated as a pawn.

  1. This is a very interesting situation. As you mentioned, some Democrats are worrying that this could turn into a situation similar to that with Ruth Bader Ginsburg which allowed Trump to appoint Amy Coney Barrett. I think it's difficult to ask someone to step down before they are ready just to ensure that another Democrat will fill the position. Regardless of whether the situation would be the right thing do or not, it seems that it would be too late for Democrats to secure a replacement at this time anyway as the process generally takes a couple of months.

  2. William, this topic is really interesting to read about, especially given the fears surrounding an already conservative Supreme Court. As we saw years ago when Mitch McConnell delayed a justice chosen by Obama's Supreme Court nomination due to it being an election year, then pushing Amy Coney Barrett in during another election year, it's no wonder the Democrats are scrambling for a solution. I see why Sotomayor would not want to step down, because there is no way they would be able to get a Biden-appointed Justice sworn in before January of 2025. It's a tricky situation, one that I'm not excited to see play out in real time.
